Forcible return of migrants and the European Convention on human rights - Italian authorities have recently undertaken a new policy to face migration flows from north african coasts. Since May, 6th 2009 Italian coastguard and financial police vessels have intercepted a large number of boats carrying migrants and returned them to Libya, in force of a readmission agreement between Italy and Libya. Il presente lavoro affronta la complessa questione della relazione esistente tra diritto alla privacy e diritto alla protezione dei dati personali. A tal fine, si è, innanzitutto, proceduto ad un’analisi del contesto normativo rilevante, tanto ai fini del diritto internazionale che del diritto dell’Unione europea. Deliberative democracy and the European Convention on Human Rights Theories of deliberative democracy have rapidly become very popular amongst political scientists. The central argument of these theories is that democratic legitimacy of lawmaking does not lie (or does not only lie) in the elected character of Parliaments but in public delib- eration processes.
